LAST WILL AND TESTAMENT

A will is a legal document that lets you tell the world who should receive which of your assets after your death. It also allows you to name guardians for any dependent children. Without a will, the courts decide what happens to your assets and who is responsible for your kids.  Wills have limitations. In particular, the beneficiary designations on financial accounts, insurance policies and other assets take precedence over wills, so it’s important to make sure your beneficiary designations are up to date and reflect your wishes.

ADVANCED DIRECTIVES

Power of Attorney and Living Will; HIPPA documents; 

One state’s advance directive does not always work in another state.  If you spend a significant amount of time in more than one state, you should complete the advance directives for all the states you spend a significant amount of time in.

Advance directives do not expire. An advance directive remains in effect until you change it. If you complete a new advance directive, it invalidates the previous one.

ASSET LIQUIDATION

In regards to assets of an Estate/Trust – The property is said to be owned by the ‘estate’ of the deceased person and must remain so until the judge says it my be distributed.  

However, it is often necessary to sell the property in order to satisfy the debts of the estate to close the probate.  We will take care of every detail, from marketing and advertising the asset to negotiating the best price for the asset and drafting any legal documents necessary for the transfer of ownership.
